In order for a rental house to feel like home, one must have confidence in a landlord. Disputes are inevitable and you must fully understand the rental agreement and be aware of your obligations and rights. The best defense against future disagreements is a well-negotiated lease that addresses the concerns of both parties.

This contract should clearly define and articulate key service and payment responsibilities. These are the most common issues and controversial disputes between landlords and tenants.

Responsibility for water damage

Water damage is a major concern for renters and homeowners. This is a common problem caused by poor plumbing pipe operation. It could also be a leak in the roof. The legal framework is evident because the landlord must offer the residents a habitable and safe environment. However, it is the tenant's responsibility to prevent further water damage by reporting the problem to the landlord immediately.

Responsibility for replacing light bulbs

There is no proven legal practice in this regard. Responsibility for light bulbs should be specified in the contract. Typically, tenants are responsible for replacing light bulbs in a home while they live in it.

Responsibility for maintaining hygienic conditions and controlling pests

Usually, the owner is responsible for preventing future pests or controlling pests. This includes sealing all cracks and fissures in the exterior walls, sealing utility openings, ceiling vents, etc. If the home for rent is not adequately protected from contamination, the responsibility rests with the landlord. However, if the tenant's bad habits lead to it, he will be held responsible. But landlords must provide proof of these unsanitary conditions as caused by the tenants.

Gutter Cleaning Responsibility

However, the controversy goes both ways, and the homeowner is usually responsible for the exterior of that home. For that reason, since the gutters are part of the exterior drain, it is believed that the owner will take care of them. It is not uncommon for landlords to pass the responsibility for cleaning the gutter onto the tenant. To avoid misunderstandings in the future, the responsibility for cleaning the gutter should be stated in the rental contract.

Responsibility for the disposal of waste

Timely waste disposal is critical to healthy living conditions. Most cities offer garbage disposal or garbage collection services for a reasonable fee. Usually, the tenants take on this task, or the landlord can perform it as part of the rent. If your area does not have a regular garbage collection service, negotiate with the landlord.

Responsibility for plumbing and clogged drains

The owner is responsible for providing habitable and safe conditions to its tenants, including the proper functioning of the water supply and sewage system. The owner must ensure that the plumbing does not damage the building or its structure and works correctly. If the sewer blockage is caused by faulty plumbing components or faulty construction, the owner is responsible for the repair. In cases where the sewerage system becomes clogged through negligence, the tenant is responsible for repairing the plumbing.

Responsibility to pay property taxes
