Malawi: MACRA Voices Concerns Over Compliance with the Cybersecurity Act

The Malawi Communications Regulatory Authority (MACRA) is grappling with the challenge of ensuring widespread compliance with the Cybersecurity Act, a legislative framework enacted in 2016 aimed at securing digital activities in the country. Despite MACRA's diligent efforts to enforce these regulations, compliance remains alarmingly low, as highlighted by Director General Daud Suleman during the commencement of a nationwide open week event held in Blantyre.

Suleman emphasized that the rapid proliferation of social media platforms has exacerbated issues of non-compliance with the Cybersecurity Act. He attributed this primarily to inadequate sensitization efforts, noting that many Malawians are unaware of the specific provisions and implications of the law. The Act, designed to safeguard digital infrastructure and user data, faces resistance and misuse, often due to misconceptions that it restricts freedom of expression guaranteed by the Malawian constitution.

To address these challenges, Suleman underscored the urgent need for comprehensive sensitization programs, particularly targeting rural communities where access to information about cybersecurity laws is limited. Moreover, Suleman called for a review and potential amendment of the Cybersecurity Act by Parliament to better align with the evolving needs and views of the Malawian populace. In addition to revisiting the Cybersecurity Act, MACRA plans to introduce new legislative measures to bolster Malawi's digital infrastructure. These include the E-Evidence Bill, which addresses digital evidence management, the Digital Innovation and Entrepreneurship Bill aimed at fostering technological advancement, the Data Protection Act to safeguard personal information, and another Cybersecurity Bill to strengthen online security frameworks comprehensively.

Minister of Information and Digitalization Moses Kunkuyu praised MACRA's proactive steps during the open week initiative, highlighting its significance in addressing persistent disputes and uncertainties between regulatory bodies and consumers. He emphasized the critical need to establish a fair and transparent communications regulatory framework that promotes efficiency across the board.
