In Compliance Move, X Will Not Use Some EU User Data to Train AI Chatbot

Social media platform X has temporarily halted the use of personal data from European Union users for training its AI systems due to consent issues, as revealed in an Irish court hearing. This development follows concerns raised by Ireland's Data Protection Commission (DPC), the lead EU regulator for many major U.S. tech companies because of their operational base in Ireland. The DPC sought legal action to restrict or suspend X from processing user data specifically for AI development, training, or refinement.

The company, owned by Elon Musk, had implemented a feature that allows users to control whether their public posts can be utilized for AI training. Users can opt out by unticking a box in their privacy settings. However, Judge Leonie Reynolds pointed out that X began processing the data of EU users for AI training on May 7, well before it offered an opt-out option on July 16. Moreover, the option was not immediately available to all users, raising further concerns about the legality of the data processing.

During the court proceedings, a lawyer representing X stated that the data collected from EU users between May 7 and August 1 would not be utilized until the court reaches a decision regarding the DPC's order. Lawyers for X are expected to file opposition papers against the suspension order by September 4.

In response to the DPC’s actions, X's Global Government Affairs account described the regulator's request as "unwarranted, overboard and singles out X without any justification." This scrutiny of data usage by X follows similar regulatory actions against other tech giants. For instance, Meta Platforms decided in June to delay the launch of its Meta AI models in Europe after receiving guidance from the Irish DPC, and Alphabet's Google also agreed to postpone and modify its Gemini AI chatbot earlier this year following consultations with the same regulator.
